A jury convicted appellant, Frabon Crocker, of aggravated robbery, and, having pleaded true to two enhancement allegations, he was sentenced to 35 years confinement. Tex. Pen. Code Ann. Γ§ 29.03 (Vernon 2003). In four issues, appellant complains that (1) the pre-trial identification procedures used by the Houston Police Department were impermissibly suggestive, (2) "the trial court erred in overruling [his] objection to the prosecutors comment on [ ] appellants failure to testify," (3) the trial court improperly defined the standard of proof during voir dire, and (4) he received ineffective assistance of counsel. We reverse and remand for a new trial.
